Shym Saunas and Spas Rental Sauna – Terms and Conditions

1.	THIS RENTAL AGREEMENT 
Thanks for taking the time to read our terms and conditions (Agreement), we are Shym Solutions Pty Ltd ACN 643 148 725 (Shym Saunas (Shym Saunas) and Spas, we, our, us and other similar terms). These terms govern the rental of sauna trailer from us online or via any other means. It also addresses certain obligations regarding your access to, and your use of our website. When we refer to you (you, your and other similar terms) we mean the person or entity renting the sauna trailer from us or otherwise using the website.
By renting the sauna trailer from us or using our website, you agree to comply with and be legally bound by the terms and conditions of this Agreement. If you do not agree to these terms, you have no right to rent/hire a sauna trailer from us or continue to use our website.
It is your obligation to ensure that you have read, understood and agree to the most recent terms published by us from time to time.

1.1	The Rental Agreement is binding and enforceable against the person renting the sauna (described as the Hirer in the Rental Booking Details Receipt), any other Authorised Driver and any person, firm or organisation who makes payment for or is liable to make any payment in connection with the rental of the sauna.  

1.2	There are words and phrases used in the Rental Agreement that have a particular meaning that You need to be familiar with. These are listed below and Capitalised throughout these Terms and Conditions
Australian Consumer Law means Schedule 2 to the Competition and Consumer Act 2010.
Accident means a collision between the Vehicle/Trailer and any other object, including another vehicle, that results in Damage.
Charge Card means the credit card or debit card You nominated for the debiting of charges under the Rental Agreement. 
Damage means loss of or damage to the Trailer including to the key, any accessory or equipment, however caused, other than reasonable wear and tear and any other property loss or damage caused by use of the Sauna trailer during the Rental Period and any subsequent period up until return of the trailer.
Damage Recovery Fee (DRF) means the amount specified in the Rental Booking Details Receipt, which You must pay Us in the event of Damage, theft of the Trailer. 
Entire Agreement - This document contains the entire agreement between the parties about its subject matter.  Any previous understanding, agreement, representation or warranty relating to that subject matter is replaced by this document and has no further effect.
Event of Force Majeure - means an act of war (whether declared or not) or terrorism, the mobilisation of armed forces, civil commotion or riot, natural disaster, health epidemic, industrial action or labour disturbance, currency restriction, embargo, action or inaction by a government, a failure of a supplier, public utility or common carrier or computer disruption due to the effects of a computer virus, trojan, malware, a ransomware attack or other malicious code.
The parties' obligations, other than an obligation to pay money, under this Agreement are suspended for the duration of and to the extent they are affected by an Event of Force Majeure. We may end this Agreement and refund the cost of any products you purchase from us if the Event of Force Majeure continues for more than 30 days.
Governing law - The laws of Tasmania, Australia govern this Agreement. The parties submit to the non-exclusive jurisdiction of courts exercising jurisdiction there.
Hiring Location means the Shym Saunas rental station from which You hired the Trailer if it was not 
delivered to you.
Incident means an Accident, an instance of Damage occurring to the Trailer, theft of the Trailer, loss of the Trailer or other incident where the Sauna/Trailer may sustain Damage or You have lost or may lose possession or control of the Trailer.
Notices - The parties agree all notices, disclosures and other communications that are provided in accordance with this clause, satisfy any legal requirement that such communications be in writing. Any communication under or in connection with this Agreement which we send to you, will be sent to you via the email address provided to us by you. By accepting these terms, you give your consent to receive communications from us by email. Your notices to us should be directed to art@staging.shymsaunas.com or sent via the facilities made available to you on our Contact Us page.
Off Road means any area that is not:
(a) a gazetted road;
(b) a sealed road; or
(c) an Unsealed Road;
including but not limited to unformed roads, fire trails, tracks, river and tidal crossings, creek beds, beaches, streams, dams, rivers, flood waters or any other body of water, sand, deserts, rocks, fields, paddocks or grassed areas.
Rental Period means the period shown in the Rental Booking Details Receipt.
Severability - Any provision of this document which is unenforceable or partly unenforceable is, where possible, to be severed to the extent necessary to make this document enforceable, unless this would materially change its intended effect.
Variations to this Agreement - We may vary this Agreement at any time by posting the new terms and conditions on our website.

1.3	Your booking 
(a)	When You make a rental booking, We will endeavour to provide a sauna requested together with any additional equipment, subject to availability.
(b)	Even if You have a valid booking, We may refuse to provide You a sauna where You do not present a drivers licence acceptable to Us (if towing a sauna), do not provide the required Security Deposit or Charge Card, fail to pay the Rental Charges, are intoxicated, aggressive or confrontational with Our staff or due to Your prior conduct.
(c)	You may cancel Your booking prior to the date and time of the commencement of Your rental. Cancellation fees may apply.
(d)	Prices for rental presented on this website are provided as an invitation to treat. The final price of the rental period for the sauna you hire is calculated at checkout or on a manually generated invoice and may include additional costs such as taxes, delivery charges and insurance.
(e)	Where you make payment via our website you are making an offer to us on the terms and conditions set out in this Agreement. We are under no obligation to accept an offer. Acceptance of your offer is deemed once we process your payment.

1.4	Use of the website
(a)	Third party infrastructure and processing
(i)	You acknowledge that our website may be operated from servers owned and controlled by a third party, and its operations rely on third party services, like those provided by payment gateway providers. As such, you acknowledge that certain functions are out of our control, including data storage and payment processing.
(ii)	You agree we are not liable for faults in the services provided by third parties (GPay, Afterpay and the like) with whom you have a separate Agreement.
(b)	Errors, updates and downtime
(i)	You acknowledge and agree that there may be technical or administrative errors in the information on the website, including but not limited to errors with respect to product description, pricing and availability.
(ii)	From time to time, without notice, access to all or part of the website may be disrupted or limited. During such an interruption, we will use reasonable endeavours to restore access to the website as soon as practicable.
(iii)	We reserve the right to upgrade, maintain, tune, backup, amend, add to or remove products/services from, redesign, improve or otherwise alter the website at our sole and absolute discretion.
(c)	Security Responsibilities
(i)	We will take reasonable steps to ensure that the website is secure from unauthorised access consistent with generally accepted industry standards. This includes implementing SSL encryption for passing payment details to the payment gateway provider.

1.5	Delivery of services (Sauna Delivery)
(a)	Unless delivery costs are included on our invoice to you, then you are required to collect the sauna from our designated rental pick up and return location in Perth, Tasmania. This clause applies where delivery is included.
(b)	We endeavour to deliver the products and services you purchase in accordance with our delivery information details to you and if not specified then within a reasonable time. 
(c)	You acknowledge and agree we are under no obligation to make goods and services available to you or any delivery service provider until we have received full payment for the goods and any services we arrange on your behalf.

1.6	Your rental period
(a)	Your rental of the sauna from Us is for the Rental Period at the rate shown in the Rental Booking Details Receipt.
(b)	The Sauna must be returned to the Shym Saunas rental station specified in the Rental Booking Details Receipt as the return location (Return Location) on the date and by the time shown in the Rental Booking Details Receipt.

1.7	Late return
(a)	If You fail to return the Sauna at the end of the Rental Period (if towed or picked up) and We have not agreed an extension to the Rental Period, We will continue to charge You the Rental Charges until the Sauna is returned. 
(b)	If We are unable to reach You using the contact details You provided or We suspect the Sauna will not be promptly returned We may:
(i)	recover the Sauna by lawful means and charge You Our reasonable costs of recovery; and/or
(ii)	report the Sauna as stolen.
(iii)	Once the Sauna is reported stolen We may charge You the fees and charges in place of the Rental Charges.
(c)	If the Rental Period has not been extended by Us and the Sauna is returned to Us more than 24 hours after the time set for its return in the Rental Booking Details Receipt there is no damage protection and You are liable for all Damage, loss of or theft of the Sauna and must pay all of Our Damages incurred. 


2.	CHARGES AND PAYMENTS

2.1	Payment of estimated Rental Charges
(a)	Prior to picking up the Sauna You must pay the estimated Rental Charges using an accepted payment method.
(b)	The estimated Rental Charges may not be all of the charges which You must pay under the Rental Agreement as additional charges may apply if circumstances change (for example where You do not return the Sauna on time, use additional services or if there is damage to the Sauna etc.).
(c)	In purchasing products or hiring rental products from us, you agree to abide by the terms and conditions imposed by your financial institution (including buy now pay later providers) and pay the amounts in relation to the transactions you authorise.
(d)	While we use only reputable payment gateway providers, we are not liable for any act or omission of the provider you choose to use. You are responsible for the payment of any goods and services, or value added taxes which are presented to you at the time of making an order.
(e)	We reserve the right to require the payment of a deposit before making any special order, holding goods or arranging for delivery of products or services. Once paid the deposit is non-refundable other than in accordance with the Australian Consumer Law.

2.2	Final Rental Charges
At the end of the Rental Period You must pay and We will charge You:
(a)	all Rental Charges calculated based on the actual period of the rental (being the period from the actual pick up time to the actual return time), less any amount paid at the start to the rental;
(b)	any Cleaning Fees applicable and all other reasonable costs required to return the Sauna and any equipment supplied to the same condition it was in at the commencement of the rental in accordance
(c)	any amounts payable in relation to Damage or loss or theft of the Sauna
(d)	all applicable card payment fees; and
(e)	any other amount payable under the Rental Agreement;

2.3	Fines and Infringements
You are liable for and must pay all fines and infringements incurred during Your rental of the Sauna, including all traffic fines, infringements and penalties and all fines, infringements and penalties arising from parking, clamping, towing, or release of the Sauna from compounds.

2.4	Security Deposit
(a)	We may charge an amount to Your Charge Card, (or take a cash deposit from You if a cash option is available at the Hiring Location) as security for additional charges which You may incur under the Rental Agreement (Security Deposit).
(b)	The Security Deposit amount may vary depending on the type of Sauna You hire and the Hiring Location. The amount of any Security Deposit taken is shown on the Rental Booking Details Receipt.
(c)	In the event You fail to provide payment for any charges You are responsible for at or after the end of Your Rental Period, We will apply the Security Deposit against these outstanding amounts.
(d)	After the Sauna has been returned and inspected and any outstanding charges or liabilities have been paid, Shym Saunas rental will refund the amount of the Security Deposit to You. Please note that it may take several business days for Your financial institution to process the refund to Your Charge Card and that the amount of time this will take is not within Shym Saunas rental control.

2.5	Refunds and defects
We provide refunds in accordance with the Australian Consumer Law.


3.	YOUR RESPONSIBILITIES 

3.1	Who may tow the Sauna
(a)	You must ensure that the Sauna is only towed by an Authorised Driver (which includes the Hirer and any Additional Driver approved by Us and noted in the Rental Booking Details Receipt).
(b)	Unless otherwise approved by Us in writing, to hire or tow a Sauna You must:
(i)	be no less than 25 years of age and 
(ii)	have full unrestricted licence, that shows Your current residential address and that is one of a photo licence in English, an international photo licence with a NATII certified translation or an international drivers permit.

3.2	Responsibilities of Additional Drivers
Whenever an Additional Driver or another Authorised Driver uses or is in control or possession of the Sauna, the Additional Driver or other Authorised Driver must comply with all of the obligations of the Hirer with respect to the Vehicle under this Agreement.

3.3	Your responsibility prior to the start of the rental
Prior to the start of Your rental You must:
(a)	allow Us to inspect Your licence and that of any Additional Driver;
(b)	pay the estimated rental charges and any required Security Deposit and provide a Charge Card for additional charges;
(c)	fully inspect the Sauna to ensure that the condition of the Sauna and any pre-existing damage is accurately noted in Sauna Condition Report, and that all equipment hired is present.
If there is any discrepancy between the Sauna Condition Report and the actual conditions of the Sauna You must notify Us prior to leaving the Hiring Location so that any damage can be noted on the Sauna Condition Report.

3.4	Your responsibilities during the rental
(a)	During the Rental Period and any subsequent period until the Sauna is returned You and any other Authorised Driver must:
(i)	(Take Care of the Sauna) take all reasonable care of the Sauna including taking care to: prevent Damage, theft of the Sauna and Third Party Loss;
(ii)	When using the sauna you agree to follow the advised operating procedure on how to use the sauna safely, (some important safety aspects are repeated here:
(A)	Check with your doctor before using a sauna, especially if you have uncontrolled high blood pressure, diabetes, heart failure, abnormal heart rhythm, or unstable angina. If you have any of these health conditions, limit your sauna use to five minutes per visit, and make sure to cool down slowly.
(B)	Check with your doctor if you’re pregnant or planning to become pregnant, before using a sauna.
(C)	Don’t use a sauna if you take medications which interfere with your body’s ability to regulate temperature, or medications which make you drowsy.
(D)	Don’t use a sauna if you’re ill.
(E)	Drink at least one full glass of water before and after using a sauna, to avoid dehydration.
(F)	Don’t drink alcohol before, during, or after sauna use.
(G)	Don’t use recreational drugs before, during, or after sauna use.
(H)	Don’t eat a large meal prior to using a sauna.
(I)	An article published in the American Journal of Public Health recommends that healthy people not sit in a sauna for more than 10 to 15 minutes at a time. If you’re new to the sauna experience, listen to your body and start slowly (for no more than 5 to 10 minutes per session). You can build up your tolerance for the heat over multiple visits.
(J)	Never let yourself fall asleep in a sauna.
(K)	Exit the sauna if you feel dizzy or ill.
(L)	The Finnish sauna tradition often ends with a plunge in freezing cold water. This may not be appropriate for everyone, especially for those who are pregnant, or those with heart or other health conditions. It may be better to let your body temperature return to normal gradually after sauna use to avoid dizziness.
(iii)	ensure that the Sauna is not overloaded by the number of persons or by the weight of goods carried and following any weight guidelines notified in the Sauna. 
(iv)	prevent damage as a result of securing the trailer and disengaging the trailer from the towing vehicle
(v)	keep the Sauna locked and secure and the keys under Your personal control at all times and You must be able to produce those keys in the event of a theft of the Sauna;
(vi)	(Operating Manual) operate the Sauna and any additional equipment in line with the operating manual 
(vii)	(No Smoking) not smoke, and ensure that no users smokes, in the Sauna (additional Cleaning Fees will apply in case this condition is breached 
(b)	You and any other Authorised Driver/Users must never:
(i)	(No Unsafe Use) use the Sauna when it is unsafe or if it has a visible fault;
(ii)	(No Drugs and Alcohol) use the Sauna whilst under the influence of alcohol or drugs or whilst having a blood alcohol content or level of drugs present in blood, urine or oral fluid that exceeds the limit in the state or territory where the Sauna is used;
(iii)	use the Sauna for any illegal purpose or in a manner which would result in a criminal offence;
(iv)	(No Dangerous Towing) tow the Sauna trailer dangerously or recklessly;
(v)	(Prohibited Use) use the Sauna in remote locations where the unsealed road has to be used for more than 5 km to reach to final destination.
(vi)	(No Disposal of Sauna) sell, rent, salvage, dispose of or otherwise part with possession of the Sauna;
(vii)	(False Information) provide Us with information You know to be false or misleading, or knowingly fail to give us all the relevant information You have when assisting Us with investigations pertaining to any Accident or other Incident, or any court proceedings related to Your Rental Agreement;
(viii)	(Dangerous goods) use the Sauna trailer for carrying any dangerous goods or substances, any flammable items or toxic substances;
(ix)	(Keys) leave the keys to the Sauna trailer, in or with the Sauna trailer whilst it is unattended or unoccupied by You or any other Authorised user;
(x)	(No Modifications and Repairs) modify, tamper with, or repair the Saunas trailer in any way or allow any person to do so;
(xi)	(No Licence Restriction) tow the Sauna trailer whilst Your driver licence is subject to any suspension, restriction or condition;
(xii)	(Animals) use the Sauna with any animals, unless specifically approved by Us. Additional cleaning fees may apply; 
(xiii)	(Ferry or Ship) transport the Sauna on a ferry or ship or other watercraft without Our permission, 


4.	RESTRICTED AREAS
Parts of Australia/Tasmania are not suitable for access by rental Sauna trailer. To prevent Damage to the Sauna and for Your own personal safety We strictly enforce conditions that restrict use of the Sauna in such areas. Unless We have given Our prior written consent, You must never take the Sauna:
(a)	on any Unsealed Road; 
(b)	in any area above the snow line, where snow chains are required;
(c)	Off Road;
(d)	across state borders;
(e)	onto any island; 
(f)	through any river, stream, creek or tidal crossing;
(g)	through flood waters or on flood prone roads or on any road where the state or condition of the road make the use of the Sauna unsafe;
(h)	on any road where the police or any government or statutory authority has issued a warning, caution or which has been closed;
(i)	onto any road or region where We have notified You that the use of the Sauna trailer is prohibited;
(j)	on any other beach in the region. 


5.	RETURN OF THE SAUNA TRAILER

5.1 At the end of the Rental Period, You must return the Sauna trailer (and/or allow unrestricted access for us to pick it up as agreed in the Rental Booking Details Receipt), the Sauna key and any accessories or equipment supplied by Us:
(a)	to the rental station specified as the Return Location in the Rental Booking Details Receipt;
(b)	in the same condition it was in at the commencement of the rental, subject to reasonable wear and tear; and
(c)	at the date and time set in the Rental Booking Details Receipt.
If You return the Vehicle to a Shym Saunas rental station different to the Return Location shown in the Rental Booking Details Receipt, We may charge You a One Way Fee at the rate $15 per km of distance.

5.2	If You return the Sauna:
(a)	to an Unmanned Location (without Our prior consent);
(b)	outside of the rental station’s operating hours; or
(c)	to any place other than a Shym Saunas rental station;
the Sauna shall not be considered returned until the location is next attended by Shym Saunas staff and We have had an opportunity to inspect the Sauna. Until this time, We will continue to charge You the Rental Charges and You remain responsible for all Damage that occurs for any reason.

5.3	Inspection
(a)	After return of the Sauna We will carry out a post rental inspection. Please allow extra time after return of the Sauna to complete the inspection with Our staff. Where the Sauna is excessively dirty, the inspection may need to occur after cleaning is complete.
(b)	If You are not able to wait for the inspection to occur, leave the rental station before the inspection or return the Sauna Trailer after hours, the inspection of the Sauna will occur in Your absence. In this case We will use Our best endeavours to confirm the condition of the Sauna with You within 4 working hours of the conduct of inspection where Damage is detected.

5.4	Sauna Trailer Condition and Cleaning
(a)	If upon return the Sauna requires cleaning exceeding fair wear and use (for example as a result of food, drink and other stains and marks, animal fur, mud, dirt, sand smoke or tobacco product damage) a cleaning fee will apply to recover the additional cleaning costs incurred. The amount of the cleaning fee will depend on the extent of cleaning required.
(b)	If upon return the Sauna or any accessory or equipment supplied is otherwise not in the same condition it was supplied in (subject to reasonable wear and tear) We may charge You for and You must pay all other reasonable costs required to return the Sauna and any equipment supplied to the same condition it was in at the commencement of the rental.

5.5	Refund of Security Deposit
(a)	If a Security Deposit has been paid it will be fully refunded to You after return of the Sauna provided that:
(i)	the Sauna and all equipment and accessories have been returned to the Return Location;
(ii)	all Rental Charges and other amounts payable under the Rental Agreement have been paid;
(iii)	there is no Damage;
(iv)	the interior and exterior are clean;
(b)	If any of the above conditions are not met, We may retain the deposit until all Rental Charges have been paid and all Damage, cleaning and other charges incurred under the Rental Agreement have been assessed and paid. In the event You fail to provide payment for such charges, the Security Deposit will be applied towards these outstanding amounts and any remaining Security Deposit will be refunded to You.


6.	OUR RESPONSIBILITIES

6.1	Sauna Quality
(a)	We are responsible for ensuring that during the Rental Period the Sauna trailer provided is of acceptable quality and in good working order.

6.2	Sauna Repair or Replacement
(a)	If the Sauna breaks down during the Rental Period through no fault of the hirer or a third party, we will recover and repair the Sauna trailer as soon as possible. 

6.3	We reserve the right not to repair or replace the Sauna where:
(a)	it is involved in a major Accident or there has been major Damage,
(b)	the cause of the relevant Sauna breakdown or fault is a breach of the Rental Agreement; or
(c)	the Sauna requires replacement due to Damage, loss or theft of the Sauna that was caused by a breach of the Rental Agreement.
In this event, the rental shall be terminated, and the Rental Period shall be at an end.


7.	LIABILITY 

7.1	Exclusion of liability
Subject to the Non-Excludable Condition and to the maximum extent permissible by law, we exclude all liability for any losses, including consequential loss, suffered, or incurred directly or indirectly by you in connection with this Agreement, including:
(a)	the website being inaccessible for any reason.
(b)	the use of products or services for a purpose they were not intended to be used;
(c)	your failure to follow any instructions or guidelines provided with the products or services;
(d)	any damage to the products or services caused by you or third parties you engage to install the goods;
(e)	your failure to comply with any State, Territory or Commonwealth laws associated with the use and installation of the goods;
(f)	any negligent act performed by you connected with the website or the goods or services; or
(g)	your breach of this Agreement. 

7.2	Limitation of liability
Where a Non-Excludable Condition is deemed to apply, to the fullest extent possible under the law, we limit our liability for any breach to:
(a)	in the case of goods, the re-supply of the goods or payment of the cost of the re-supply of the goods or the replacement or repair of the goods or payment of the cost of replacement or repair of the goods; and
(b)	in the case of services, the resupply of the services or the payment of the cost of having the services resupplied.


8.	ACCIDENT, DAMAGE, LOSS OR THEFT OF SAUNA
This section describes what You must do if there is an Accident, any instance of Damage, theft of the Sauna, loss of the Sauna or any other incident where the Sauna may sustain Damage or You have lost or may lose possession or control of the Sauna (Incident). 

8.1 When to Notify the Police
(a)	You must notify the police immediately if there is an Accident or other Incident where:
(i)	a person is injured;
(ii)	the other party failed to stop or exchange details;
(iii)	any driver involved appears to be under the influence of drugs or alcohol;
(iv)	the Accident or Incident is required to be notified to the police under applicable legislation;
(v)	theft of the Sauna trailer is discovered; or
(vi)	We instruct to do so.
(b)	Notify Us (by contacting the Hiring Location) as soon as possible after the Accident, Damage or other Incident and no later than 24 hours after it occurs

8.2	What You must pay us for Damage
(a)	Each time there is Damage or theft or loss of the Sauna trailer, You will be responsible for and must pay the excess fee as specified in the Rental Booking Details Receipt;


9.	TERMINATION OF THE RENTAL
9.1	Termination of the Rental
(a)	We may terminate the rental in the event of:
(i)	a breach of the Rental Agreement that causes Damage or loss of or theft of the Sauna or that has put the Sauna at immediate threat of loss or Damage;
(ii)	a reckless breach of road or traffic legislation;
(iii)	the Sauna being involved in a major Accident or where there has been major Damage;
(b)	If the rental is terminated as described above:
(i)	the Rental Period shall be at an end and You must immediately return the Sauna;
(ii)	We may also take immediate possession of the Sauna, and for this purpose You give Us permission to access and enter Your premises to repossess the Sauna without using unreasonable force or causing damage;
(iii)	You must pay and We may charge You all amounts due under the Rental Agreement; and
(iv)	the Rental Agreement and all Our rights under the Rental Agreement shall otherwise remain in full force and effect.


10.	PRIVACY POLICY
Our Privacy Policy (located at https://staging.shymsaunas.com/privacy-policy-2/) sets out how and for what purpose We collect, use, store and disclose personal information.
By entering into the Rental Agreement and by providing Us personal information, You and each Additional User represent and We proceed on the basis that You and the Additional User have read and agree to the terms of Our Privacy Policy and consent to Your personal information being collected, used and disclosed for the purposes and in the manner described in the Privacy Policy. We may amend our privacy policy in our sole discretion.  If we amend our privacy policy, we will post it on our website.  


11.	INTELLECTUAL PROPERTY 
When we talk about Intellectual Property we mean all present and future rights conferred by statute, common law or equity (and all moral rights) in or in relation to business names, computer software, confidential information, copyright, designs, domain names, inventions, knowhow, patents, trademarks, and other results of intellectual activity in the industrial, commercial, scientific, literary or artistic field, the benefit of any application to register such a right and the benefit of any renewal or extension of such a right (Intellectual Property).
We own or have a licence to use all the Intellectual Property on the website and our YouTube channel. You warrant that you will not do any of the following, or permit any person over whom you have effective control to do so:
(a)	copy or reproduce, or create an adaptation or translation of, all or part of the website in any way, except to the extent that reproduction occurs automatically through the ordinary use of the website;
(b)	incorporate all or part of the website in any other webpage, site, application or other digital or non-digital format; or
(c)	sell, license, sublicense, lease, rent, distribute, disclose, permit access to, or transfer to any third party, whether for profit or without charge, any portion of the website on any medium.


12.	GENERAL
Nothing in the Rental Agreement excludes, restricts or modifies Your rights under the Australian Consumer Law or other applicable consumer protection legislation.
The laws of the state in which the Hiring Location is situated govern the Rental Agreement.


13.	INDEMNITY
You indemnify us, including our directors, employees, contractors, agents, subsidiaries and related bodies corporate against all costs suffered or incurred, however caused, arising wholly or partially, directly or indirectly, in connection with this Agreement or your use of the website, including any costs arising from:
a)	your breach of this Agreement;
b)	our collection activities in relation to a debt you have to us;
c)	your failure to comply with any State, Territory or Commonwealth laws associated with the use and installation of the goods and services provided;
d)	your infringement of any Intellectual Property and our costs of protecting those rights; or
e)	any harm to, claim or action by a third party arising directly or indirectly from your use of the website or goods and services you purchase.
